Plan to Scrap Employment Tribunal Fees Could Result in More Cases

The Scottish Government has announced it is considering plans to scrap all employment fees

Last year, the number of employment tribunals fell by a whopping 79% according to statistics from the TUC. According to the Union, there was “no obvious explanation, other than the introduction of fees”. However, as some stated that the introduction of fees would prevent those from accessing justice, according to some legal experts it is also clear that many employment cases have not been taken forward because they were not worth the risk of paying a nominal fee.

Under the tribunal fee changes which came into effect in July 2013 applicants had pay either £160 for lodging a claim and £230 for a hearing or, in more complex cases (including unfair dismissal and discrimination claims) fees of £250 to lodge a claim and £950 for a hearing. Such fees have led to much outcry with the UK Government promising to carry out an extensive review of the employment tribunal system.

Calls to Abolish Fees

The calls to abolish such fees have been made by many groups such as most trade unions and Citizen’s Advice Scotland, as they believe their introduction has significantly impacted upon claimants’ access to justice. According to the Scottish Government abolishing such fees will “create a fairer country. We will promote a proper living wage, fair work and use new powers to improve the welfare system, mitigating some of the worst impacts of the UK Government’s cuts.”
