Focus on expert evidence in family courts

The process of experts giving evidence in family courts is under the spotlight in England and Wales, with the Government publishing details of new national standards that it says will reduce unnecessary delays in court and increase the quality of the evidence giving.

“It is important that expert witnesses are used effectively in deciding the future of vulnerable children,” said Family Justice Minister Lord McNally. “These new standards put the welfare of children at the heart of the system, so only the highest calibre evidence is permitted and cases are resolved quickly.”

Appearing in a family court can be a highly stressful experience for children, and any delays in the process can only exacerbate this stress. According to the Government, one of the biggest causes of delay in family court cases is the costly and unnecessary commissioning of additional written statements, clarifications and court appearances by expert witnesses.

Therefore, the new standards are designed to ensure that only qualified, experienced and recognised professionals can give evidence as expert witnesses in family proceedings relating to children.
