A high court judge has ruled that a prenuptial agreement between a divorcing couple should be set aside and the husband receive a divorce settlement worth around £1.2 million, reports the Guardian.
The case concerned the divorce of Frankie Limata and Victoria Luckwell, who is the daughter of Mike Luckwell, a millionaire with links to the media company behind the highly successful children’s programme, Bob the Builder.
There was a large financial gap between the couple when they wed in 2005, with Victoria owning the London home where the couple lived, which is thought to be worth around £6.7 million and was a gift from her father.
Frankie had no real assets, and by the end of the marriage had debts of around £226,000. He had reportedly promised to make no financial claim on his wife should the marriage end, and had signed a prenuptial agreement, plus two supplementary agreements, to that effect.
However, when the marriage ended in 2012, the judge hearing the divorce case ruled that Frankie was entitled to sufficient funds to clear his debts and enable him to buy a home suitable for the couple’s three children to stay in when they came to visit him, says the Guardian.
The judge further ruled that when the youngest child reached the age of 22, this house should be sold, with Victoria retaining 45% of the proceeds and the rest to be used by Frankie to buy a long-term home.
