The Uniqueness of Conveyancing

As it is nearly Christmas time, a Christmas analogy seems apt. Every conveyance is unique like a snowflake. Each presents unique issues to be addressed.

Cladding is a significant issue with modern buildings, due to concerns regarding fire safety. Buildings with cladding are difficult to insure and may prove problematic in securing mortgage funds. It is therefore essential that when purchasing or selling a property with cladding that an External Wall System Fire Review (EWS1) certificate is present. At Miller Samuel Hill Brown, we are well versed in assisting clients in acquiring the appropriate consents relating to cladding.

Other issues can also arise with insurers. Dependent upon where the property is located, certain mortgage providers may have difficulty issuing a mortgage: for example, if the property is above a restaurant or shop. As you may have seen recently reported in the news, properties with incorrectly installed foam insulation also have difficulty securing mortgages. Geography also plays a significant role in conveyancing, particularly if your property is in a historic coal mining area. If that is the case, having a quality coal mining report is essential to identify if there is a mineshaft immediately surrounding your property which could affect your sale. Similarly, proximity to bodies of water can impact conveyancing transactions. Flood reports are an integral part of conveyancing checks to satisfy ourselves and insurers during a conveyance.

Rural properties pose unique challenges in relation to connection to mains water and sanitation. Due to Miller Samuel Hill Brown's all Scotland scope we are familiar with liaising with the Scottish Environmental Protection Agency (SEPA) to establish that a property has a septic tank and has the relevant consent certificates from SEPA.
